Terms of Service

1. Agreement to Terms

By accessing or using PirkSocial ("Platform", "Service"), operated by PIRK LLC dba PirkUS.AI ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and PIRK LLC dba PirkUS.AI.

PirkSocial is a multi-tenant SaaS platform available in multiple regions. The governing law and jurisdiction depend on your deployment region as specified in Section 14.

2. Eligibility

  • You must be at least 18 years of age
  • You must be a professional, business owner, or authorized representative of a business
  • You must provide accurate and complete registration information
  • You are responsible for all activity under your account

3. Service Description

PirkSocial provides an AI-powered social media management platform offering 16 integrated marketing pillars including content generation, multi-platform publishing, reputation management, lead management, WhatsApp automation, SEO, advertising management, and analytics.

AI content is generated using Amazon Bedrock foundation models. All AI-generated content should be reviewed by you before publishing. We do not guarantee the accuracy, compliance, or suitability of AI-generated content for any specific purpose.

4. Subscriptions & Billing

4.1 Plans & Pricing

Plans are offered at region-specific prices in USD (United States), INR (India), and AED (UAE). Current pricing is displayed on our Pricing page. We reserve the right to modify pricing with 30 days' notice.

4.2 Free Trial

New accounts receive a 7-day free trial. No credit card is required. At the end of the trial, you must subscribe to a paid plan to continue accessing premium features.

4.3 Payment Processing

  • United States & UAE: Payments processed by Stripe, Inc.
  • India: Payments processed by Stripe India Private Limited, which acts as our Merchant of Record (MoR) and Seller of Record (SoR). Stripe India is responsible for GST invoicing, tax compliance, and payment collection in India. Revenue is transferred to PIRK LLC dba PirkUS.AI in compliance with applicable regulations.

4.4 Cancellation & Refunds

You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods. For annual plans, a prorated refund may be requested within 14 days of the annual renewal.

5. Acceptable Use Policy

You agree not to use PirkSocial to:

  • Generate or distribute misleading, fraudulent, or deceptive content
  • Publish content that violates applicable advertising standards or professional codes of conduct
  • Share Protected Health Information (PHI) in social media posts without proper authorization and de-identification (HIPAA)
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to reverse engineer, scrape, or misuse the AI content generation system
  • Use the platform for spam, unsolicited messages, or bulk unauthorized communications
  • Circumvent usage limits or create multiple accounts to avoid billing

6. Additional Terms for Healthcare Professionals (US)

If you are a healthcare professional or covered entity under HIPAA:

  • You are solely responsible for ensuring that no unsanitized PHI is included in any content generated, published, or stored through PirkSocial
  • A Business Associate Agreement (BAA) is available for Enterprise plan subscribers upon request
  • Patient testimonials and reviews must be collected with proper written consent, which you are responsible for obtaining
  • AI-generated content for healthcare should be reviewed for clinical accuracy before publishing
  • PirkSocial is a marketing tool, not an Electronic Health Record (EHR) system

7. Intellectual Property

7.1 Your Content

You retain ownership of all content you create, upload, or generate through PirkSocial. By using our AI generation features, you are granted a perpetual, non-exclusive license to use the generated content for any lawful purpose.

7.2 Our Platform

PirkSocial, its code, design, features, and documentation are owned by PIRK LLC dba PirkUS.AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the platform.

7.3 AI-Generated Content

AI-generated content may resemble content created by others. We do not guarantee that AI output is unique or free from intellectual property claims. You are responsible for reviewing content before publishing.

8. Data Protection & Compliance

Our data practices are governed by our Privacy Policy. By using PirkSocial, you acknowledge and agree to the data practices described therein.

  • We implement industry-standard security measures including AES-256 encryption and TLS 1.3
  • Each tenant's data is logically isolated using partition-based multi-tenancy
  • Data is stored in the AWS region corresponding to your deployment (US, India, or UAE)
  • We comply with HIPAA (US), DPDPA (India), and GDPR (EU/UAE) as applicable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIRKUS.AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF PIRKSOCIAL.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimers

  • PirkSocial is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • AI-generated content is for informational purposes and should be reviewed before publishing
  • We are not responsible for the content you publish to third-party social media platforms
  • Integration with third-party platforms (LinkedIn, Instagram, etc.) is subject to those platforms' terms of service

11. Indemnification

You agree to indemnify and hold harmless PIRK LLC dba PirkUS.AI, its officers, directors, and employees from any claims, damages, or expenses arising from: (a) your use of PirkSocial, (b) content you create or publish through the platform, (c) your violation of these Terms, or (d) your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to PirkSocial if you violate these Terms, fail to pay subscription fees, or engage in activities that harm the platform or other users. Upon termination, your data will be retained for 90 days before permanent deletion, unless longer retention is required by law.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email and/or in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

14. Governing Law & Jurisdiction

  • US users: Governed by the laws of the State of Delaware, USA. Disputes shall be resolved in the courts of Delaware.
  • India users: Governed by the laws of India. Disputes shall be resolved in the courts of Mumbai, Maharashtra, subject to arbitration under the Arbitration and Conciliation Act, 1996.
  • UAE users: Governed by the laws of the UAE. Disputes shall be resolved in the courts of Dubai.
